Please read these Terms of Service carefully before using our website or engaging Pixelate Nest (operated by Kalahanu Tech Studios LLP) for any services. By accessing our website or placing an order, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing pixelatenest.com or using any of our services, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to be bound by these Terms of Service. If you do not agree to any part of these terms, please do not use our services.

2. Services

Pixelate Nest provides creative and technology services including but not limited to: web development, mobile app development, software development, video editing, digital marketing, UI/UX design, and website hosting & maintenance. The specific scope of work, deliverables, timelines, and pricing for each project are defined in a separate project proposal or service agreement.

3. Payment Terms

Payment terms are specified in the project proposal. Unless otherwise agreed in writing:

• A minimum of 50% advance payment is required before project commencement
• Remaining balance is due upon project completion and before final delivery
• Accepted payment methods: Bank transfer (NEFT/RTGS/IMPS), UPI, and cash
• Late payments may incur a penalty of 2% per month on the outstanding amount
• All prices are in Indian Rupees (INR) unless otherwise specified

4. Intellectual Property

Upon receipt of full payment, the client receives ownership of all custom deliverables created specifically for their project. The following are excluded from this transfer:

• Third-party software, libraries, or frameworks used (governed by their own licences)
• Pixelate Nest's proprietary tools, templates, and pre-built components
• Stock assets (images, fonts, icons) which remain subject to their original licence terms

Pixelate Nest retains the right to display completed work in its portfolio unless the client requests confidentiality in writing.

5. Client Responsibilities

The client agrees to:

• Provide accurate and complete project requirements, content, and materials in a timely manner
• Review and provide feedback within the agreed timeframes
• Ensure they have the rights to any content, images, or materials provided to us
• Not use our services for illegal, harmful, or unethical purposes

6. Revisions & Change Requests

Each project includes a defined number of revision rounds as specified in the project proposal. Additional revisions or scope changes beyond the agreed scope will be quoted separately and require written approval before work commences.

7. Cancellation & Refunds

If a project is cancelled by the client after commencement, the advance payment is non-refundable. Any work completed up to the cancellation date will be invoiced at a pro-rated rate based on the agreed project fee. Please refer to our Refund Policy for full details.

8. Limitation of Liability

To the fullest extent permitted by law, Pixelate Nest shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of profits, data loss, or business interruption. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of the project.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Muzaffarpur, Bihar, India.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes take effect upon posting to this page. Continued use of our services after changes constitutes acceptance of the revised terms.
